How much money was in the surplus?

While there has always been some carryover since the inception of Fund 12, as well as some underutilization of the fund, much of that carryover was paid to eligible employees before school year 2012-2013.

In fact, some employees may remember receiving a double payment during school year 2008-2009.

The current surplus was limited to carryover from school years 2012-2013 through 2015-2016.

The estimated surplus, which included the interest earned in the fund, was approximately $9.5 million.

This amount included funds that must be used to pay employee benefit payments associated with Fund 12 payments.

Addressing the surplus balance in Prop 301 Fund 12

At the December 13, 2016 Governing Board meeting, the board approved the amendment to address to the Performance Pay Fund surplus.

The amendment allows for former eligible employees to return to the classroom in order to participate in the 2016 plan. If you are interested in this, please read 301 Pay for Performance Plan amendment: Important information for former eligible employees.

The board also directed the district to enact a "plan B" at the request of teachers who attended the meeting. Dr. Sánchez agreed with the idea and presented it to the board at the December 13, 2016 meeting. Essentially, if any surplus remains in the fund for the 16-17 school year, a plan will be developed to distribute the money to plan eligible teachers right away. The funds will not roll over into the next plan year.

Background Information

In November 2016, the Joint TEA/TUSD 301 Classroom Site Fund Planning Committee reconvened to address the Performance Pay Fund surplus existing after the current 301 Pay for Performance Plan is fully funded.

The Governing Board has recognized this joint committee, through the Consensus Agreement, as the committee responsible for preparing the 301 Pay for Performance Plan. Upon reconvening, the joint committee sent a survey to all current 301 eligible teachers to rank three 301 surplus payout options developed from suggestions that were made by teachers at the 301 forums that TEA hosted in October.

The current plan must be fully funded since participants have started to attend their PLCs in anticipation of receiving their payment. Based on the survey results, the joint committee prepared and sent the amendment to all 301 eligible teachers for their vote for approval. The amendment could only address the excess that remains after the current plan is paid in full.

The amendment was then sent to eligible teachers for vote. To be adopted, the amendment needed to receive at least 70% vote of approval. The amendment received 73.6% vote of approval, and so the joint committee presented the amendment to the Tucson Unified Governing Board for approval at the December 13, 2016 Governing Board Meeting, during which the board approved the amendment.

301 Pay for Performance Plan amendment: Important information for former eligible employees

If you worked for Tucson Unified School District during the 2012-2013, 2013-2014, 2014-2015 or 2015-2016 school years and were eligible for a Fund 12 payment under the applicable 301 Pay for Performance Plan, then you can now be hired and placed into a classroom teacher position, subject to district hiring policies and procedures, and you can participate in the 301 Pay for Performance Plan for 2016-2017.More

Here's a checklist to help ensure you receive your 301 payment.

In addition to 7 PLC hours, grandfathered staff members must

  • ...have held a valid Arizona teacher certificate throughout the 2016‐2017 school year.
  • ...maintain a valid Arizona teacher certificate for the duration of the 2017‐2018 school year.
  • ...have participated in the 2016‐2017 301 (Fund 12) Pay for Performance Plan.
  • ...meet with evaluator by Wednesday, November 1, 2017 (extended from August) to complete the Direct Instruction Plan form and log, to be signed by both the staff member and the evaluator.
  • ...execute and submit the Direct Instruction Plan and logs by March 14, 2018 with written confirmation from evaluator that the plan was fully executed.
  • ...submit the signed Direct Instruction Plan and log to evaluator each quarter by the following dates:
    • Quarter 1 – Due by November 1, 2017
    • Quarter 2 – Due by December 20, 2017
    • Quarter 3 – Due by March 14, 2018
    • Quarter 4 – Due by May 10, 2018  
  • ...satisfy all remaining criteria for eligibility under the 2017‐2018 301 (Fund 12) Pay for Performance.
